These Terms and Conditions ("Terms") govern your use of SCA Simulator (the "Service"), owned and operated by [COMPANY NAME] Ltd, registered in England and Wales, company number [COMPANY NUMBER], registered address [REGISTERED ADDRESS] ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
1.1 SCA Simulator is an educational platform for GP trainees preparing for the MRCGP Simulated Consultation Assessment (SCA). It provides: (a) a library of written practice cases, free to read and download with a registered account; (b) voice-based practice consultations with an AI-simulated patient, graded with AI-generated feedback ("AI Consultations"); and (c) AI-generated coaching reports ("Deep Insight").
1.2 The Service is an independent educational product. We are not affiliated with, endorsed by, or connected to the Royal College of General Practitioners (RCGP). "SCA" is used to describe the examination the Service helps you prepare for.
2. Accounts
2.1 You must be at least 18 years old to create an account.
2.2 Accounts are personal to you. You must not share your login details or allow anyone else to use your account. Each user requires their own account.
2.3 You are responsible for keeping your password secure and for activity on your account. Tell us promptly at [CONTACT EMAIL] if you believe your account has been compromised.
2.4 You must provide accurate information when registering and keep it up to date.
3. Free content and licence
3.1 With a registered account, the written case library is free to read online and download in the formats we provide. Certain materials (for example our SCA preparation guide) may be made available without an account.
3.2 We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use all content on the Service — including written cases, downloads, AI Consultation transcripts, feedback reports, and Deep Insight reports — for your own personal, non-commercial exam preparation only.
3.3 You must not copy, republish, distribute, sell, licence, share in bulk, upload to other platforms, use to train or develop any machine-learning system, or create derivative products from any content on the Service, in whole or in part, without our prior written permission. Personal study use — including printing your own copies and practising with a study partner in person — is fine and intended.
3.4 All content, software, branding, and design of the Service are our exclusive property or that of our licensors. All rights not expressly granted are reserved. We take unauthorised copying seriously and reserve the right to suspend or terminate accounts involved in it (clause 9) and to take legal action.
4. Credits and payment
4.1 AI Consultations and Deep Insight reports require credits. Current credit packs and prices are shown on the Service at the time of purchase. Prices may change; changes never affect credits you have already bought.
4.2 One credit starts one AI Consultation. One credit generates one Deep Insight report. Reading and downloading written cases never costs credits.
4.3 Credits are valid for 6 months from the date of purchase and expire after that. The validity period is stated at purchase, and your account page shows your balance and the earliest expiry date at all times. Credits are consumed oldest-first.
4.4 Payments are processed by our payment provider (Stripe). We never see or store your card details.
4.5 If an AI Consultation fails before any exchange with the AI patient has taken place (for example a technical failure at the start of a session), the credit is automatically returned to your balance. The same applies to a Deep Insight report that fails to generate.
4.6 Credits are personal to your account and cannot be transferred, shared, or exchanged for cash.
5. Cancellation and refunds
5.1 14-day cancellation right (unused packs only). You may cancel a credit pack purchase within 14 days of purchase and receive a full refund of that pack, provided no credit from that pack has been used.
5.2 Using a pack ends the cancellation right for that pack. At checkout you expressly consent to us supplying the digital service immediately and acknowledge that once you begin using a pack — by starting any AI Consultation or generating any Deep Insight report with a credit from it — you lose the right to cancel that pack, and it becomes non-refundable. This means a partly-used pack cannot be refunded in whole or in part.
5.3 Expired credits are not refundable.
5.4 Nothing in these Terms affects your statutory rights, including any right to a remedy if the digital service we supply is faulty.
5.5 There is no subscription and no recurring charge anywhere on the Service. You are only ever charged when you choose to buy a pack.
6. Educational purpose — important disclaimers
6.1 No exam outcome guarantee. We cannot and do not guarantee that using the Service will result in passing the SCA or any other examination. The Service is one preparation tool and should be used alongside your wider training.
6.2 All cases are fictitious. They are written by us, based on the kinds of scenarios GPs manage in day-to-day practice. Any resemblance to real patients, or to cases appearing in any actual examination, is coincidental.
6.3 AI-generated content may be imperfect. AI Consultations, grading, feedback, and Deep Insight reports are generated by artificial intelligence. They are provided for education and practice; they may contain errors or omissions, and grades on the Service are practice estimates, not predictions or guarantees of real examination performance.
6.4 Not medical advice. All medical information on the Service is provided for the education of clinicians in an exam-preparation context. It is not clinical advice, must not be used to make decisions about real patients, and is not intended for members of the public. While we work to keep content current with UK guidance, we make no warranty that any content is complete, accurate, or up to date.
6.5 Clinical sources. Our content is authored by us and informed by publicly available UK clinical guidance and reference sources (such as NICE guidelines, NICE CKS, and the BNF). Where such sources are named, the names and trademarks belong to their respective owners; we are not affiliated with, endorsed by, or approved by any of them. Clinical guidance changes over time — for real clinical practice, always rely on the current official sources directly, not on content from the Service.
7. Recordings and your data
7.1 AI Consultations involve recording and processing your voice. Audio, transcripts, grades, and reports are stored in your account so you can review your progress, and are processed by the third-party AI service providers we use to operate the Service.
7.2 By starting an AI Consultation you consent to this recording and processing. Details of what we store, how long, and your rights are in our Privacy Policy, which forms part of these Terms.
8. Acceptable use
You must not: (a) share, resell, or publish Service content beyond the personal licence in clause 3; (b) access or attempt to access the Service by automated means (scraping, bulk downloading, bots); (c) attempt to extract, reverse-engineer, or misuse the AI systems, prompts, or case bank; (d) use the Service to build or assist a competing product; (e) interfere with the operation or security of the Service; or (f) use the Service unlawfully.
9. Suspension and termination
9.1 You may close your account at any time from your account page or by contacting us.
9.2 We may suspend or terminate your account if you materially breach these Terms (including clauses 2.2, 3.3, and 8). Credits remaining on an account terminated for material breach are forfeited.
9.3 If we terminate your account other than for breach, we will refund the unused, unexpired credits on your account.
9.4 If we discontinue the Service, we will give at least one month's notice on the Service. During the notice period pack sales stop and your remaining credits stay fully usable. Any credits still unused and unexpired at closure will be refunded.
10. Availability and changes to the Service
10.1 We aim to keep the Service available and reliable but do not guarantee uninterrupted availability. We may modify features of the Service; if a change materially reduces what your existing credits can be used for, clause 9.3 applies to those credits on request.
11. Liability
11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under the law of England and Wales, and nothing affects your statutory rights as a consumer.
11.2 Subject to 11.1: we are not liable for losses arising from your use of content in real clinical practice contrary to clause 6.4; for indirect or consequential losses; for loss of profit or opportunity (including examination outcomes); and our total liability to you in connection with the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.
11.3 External links on the Service lead to sites we do not control and do not endorse; we are not responsible for their content.
12. Feedback
If you send us feedback or suggestions about the Service, you grant us a perpetual, royalty-free licence to use them, including in anonymised form in our marketing. We will never publish anything identifying you without your separate consent.
13. Changes to these Terms
We may update these Terms. For material changes we will give notice on the Service (and by email once email features exist) before they take effect. Continued use after the effective date constitutes acceptance. The Terms in force at the time of each credit purchase govern that purchase.
14. General
14.1 These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Service.
14.2 If any provision is found invalid, the remainder continues in force.
14.3 We may assign these Terms as part of a transfer of the business; you may not assign your account.
14.4 A delay in enforcing any right is not a waiver of it.
15. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales (nothing prevents consumers relying on mandatory protections of their home jurisdiction within the UK).
